COD MWIII Early Access Beta Oceania and South East Asia Giveaway – Terms and Conditions

1. Giveaway Details

Activision Blizzard Pty Ltd., a company with address at Wharf 10 – Suite 2 / Level 2, 50-52 Pirrama Road, Pyrmont NSW 2009, Australia (the “Promoter”) is running an online giveaway (the “Giveaway”). The opening times and dates of the Giveaway are at 14:00 (AEDT) 7/10/2023 (for Australia and New Zealand residents) ", 13:00 (GMT+7) 10/10/2023 (for Thailand residents) and 12:00 (GMT +8) 7/10/2023 (for residents from other eligible countries) , and the closing times and dates for receipt of entries are at 23:59 (AEDT) 14/10/2023 (for Australia and New Zealand residents) and 23:59 (GMT +8) 14/10/2023 (for residents from other eligible countries) (the “Giveaway Period”). Entries submitted after this time will not be considered.

2. Restrictions

This Giveaway is only open to Australia and New Zealand residents aged fifteen (15) and over and Thailand, Philippines, and Singapore residents aged eighteen (18) and over. Directors, officers and employees of the Promoter and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies involved in the Giveaway, and immediate family members and those living in the same household of such persons (whether legally related or not) are not eligible to enter or win any Prize in this Giveaway. Subject to all applicable laws and regulations.

3. Rules to participate

No purchase of any goods or services is necessary to be eligible for entry into this Giveaway.

To participate, users must simply provide their answer to two multiple-answer questions, and their email address (for verification purposes), through a web form.

Each entrant may only enter the Giveway one (1) time during the Giveway Period. Submissions received from any person, account or email address in excess of the stated limit will be void.

4. Prize(s)

Each entrant will receive a digital code to activate the Call of Duty: Modern Warfare III Early Access Open Beta on PlayStation, Xbox, Battle.net or Steam (the “Prize”), subject to availability. Each Prize will grant temporary Early Access to the Call of Duty: Modern Warfare III Open Beta for a minimum of 2 days prior to the game full launch on 10 November  2023. Early Access begins on 7-8 October (depending on region) for PlayStation, and on 13-14 October (depending on region) for all other platforms. Prizes that have not been redeemed before 16 October 2023 shall become forfeited and invalid. A minimum of (i) 3.000 Prizes for Australia and New Zealand, and (ii) 3.000 Prizes for other eligible countries, are available for the Giveaway on a first come first served basis.

Promoter will be responsible for Prize fulfilment.

There is no alternatives to this Prize. It is as stated and is non-transferable. If due to circumstances beyond the control of Promoter, Promoter is unable to provide the Prize, Promoter reserves the right to award substitute prizes of equal value. All prizes are subject to the terms and conditions of the supplier. Any taxes due on the prizes will be paid by the winner save for any tax which is required to be paid by Promoter under the applicable laws.

6. Data protection

By participating in this Giveaway, entrants hereby acknowledge that Activision Publishing, Inc. and Deployable Pty Ltd. may collect and use their personal data in compliance with applicable laws and regulations and the locally applicable version of the Privacy Policies accessible at https://www.activision.com/au/en/legal/privacy-policy and https://www.deployable.co/legal in order to organise, run and monitor the Giveaway. Entrants confirm that they have acknowledged Activision’s and Deployable’s Privacy Policies. Entrants’ personal data may be transferred to the United States of America for the purpose of this Giveaway, in accordance with Activision’s Privacy Policy. Entrants have the right to access, ask for erasure, and correction of their personal data to Promoter and can request such action at https://support.activision.com/privacy. Please note that if you withdraw your personal data prior to the determination of the winner or fulfilment of the Prize, Promoter will not be able to include you in the Giveaway and, should you win, send the Prize to you.

6. General Conditions

Any entry, which does not comply with the rules, may be deemed invalid at the sole discretion of Promoter. Promoter is not responsible for technical, hardware or software malfunctions, misdirected entries, lost or unavailable network connections, failed, incorrect, garbled, delayed electronic or other communications or other technical problems related to mobile entries. Proof of sending will not be deemed to be proof of delivery.

Any entrant who enters or attempts to enter the Giveaway in a manner, which in Promoter’s determination is contrary to these rules or by its nature is fraudulent or unjust to other entrants including without limitation tampering with the operation of the Giveaway, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other entrants or Promoter and/or any of its agents or representatives, or who submits an illegible or incomplete entry may be rejected from the Giveaway at Promoter’s sole discretion.

By entering this Giveaway, entrants agree to be bound by these Terms and Conditions and by any other requirements set out in the promotional material. Promoter reserves the right to modify, cancel, terminate or suspend the Giveaway in whole or in part, at its sole discretion, if it believes the Giveaway is not capable of being conducted as specified in these rules or in the event of a virus, a computer bug or unauthorised human intervention or any other cause that is beyond reasonable control of Promoter that could corrupt or affect the administration, security, impartiality or normal course of the Giveaway.

This Giveaway is governed by and is in accordance with the laws of New South Wales, Australia.
